no, the OERI legislation is for the new academy.

Yes. Way back when, the plan was to take OERI out of the Dept. of Ed
and make it an academy, like the national academy of sciences. But
the democrats objected and so it is still in the US Dept of Ed but it
is called an academy and the director has a six year term... so I
guess it is somewhat independent.
